The Constitution of Kenya 2010 declared water supply and sanitation services a basic right and assigned the responsibility for water supply and sanitation provision to the 47 Counties. Key legislation, including the County Government Act of 2012 and the Urban Areas and Cities Act of 2011, have provided the framework for devolving the water function.
The national water regulator should play a strong role in monitoring sector performance and enforcing compliance.
National government is mandated to support counties in consultation with county leadership and other stakeholders.
